I just bought a brand new ducati gt 1000 motorcycle from lexington motorsports, kentucky, which was delivered to my house on 3 october 2010 with a deforming/loosening fuel tank. On 18 nov 2010, girard gibbs llp filed a class action against ducati north america for knowingly selling these defective fuel tanks and not fixing the problem since 2006. *tr

I'm resubmitting this complaint as i'm under the impression my previous one for the same cause was not filed. Issue is i noticed a deformed/loose fuel tank on my brand new, 2009 ducati gt 1000 motorcycle upon delivery from the dealership. The tank has expanded and is no longer secured by it's two front brackets (two of the three securing points for the fuel tank). The tank moves/wobbles approx half and inch to the left or right, and a single rear bolt is keeping it on the motorcycle. I believe the tank is likely to fly off in the event of an accident so i haven't ridden the motorcycle and intend to return it to the dealership under "breach of warranty". Ducati's limited warranty on emission applies to the sale of motorcycles designed, built and equipped to conform at time of retail purchase to be free from defect in material and workmanship which would cause it to fail epa regulations. "breach of warranty" is the determination that a statement as to title of property, including real property or any goods, is proved to be untrue, whether intended as a falsehood or not. It can also apply to an assurance of quality of a product or item sold. The part making the warranty is liable to the party to whom the guarantee was made. In modern law the warranty need not be expressed in so many words, but may be implied from the circumstances or surrounding language at the time of sale." this is also the reason for 22 november class action against ducati north america for continuing to sell these motorcycles with defective fuel tanks. *tr

Gas tank has deformed causing it to become loose from the frame to the point it had to be secured with straps. I have owned the motorcycle (purchased new) for 19 months and in that time the gas tank has been replaced twice due to this deformation. *tr

In june, i purchased a 2009 ducati gt1000 brand new from a dealer in ft. Myers, florida. Upon delivery, the gas tank was completely deformed so that the rubber bumpers intended to secure the tank to the frame no longer sat in the frame's brackets. Consequently, the tank is merely resting on the frame, unsecured to the bike. Though the tank is brand new, i've taken it to a dealer who said the deformity is bad enough that ducati is replacing the tank under warranty. But they are doing so with a tank that isn't any different from the current tank, making it--and me--susceptible to continued problems and protracted intervals of having the bike at the dealerships. *tr

I own a 2009 ducati sport classic gt1000. I have put 2,500 miles on the bike and the fuel tank bowed outward and no longer attaches to the frame of my bike. Causing the fuel tank to become extremely wobbly and loose. This bike has never been in any accidents. This seems to be a common defect with ducati fuel tanks. *tr

2009 ducati gt 1000 fuel tank mount problems: the fuel tank has apparently stretched out in width to such an extent that the front mount no longer secures the tank. As a consequence the tank is loose and held in place only by the rear securing bolt, which is totally inadequate and wasn't designed to hold the tank on its own. I feel this is a very dangerous situation and a potential death trap. *tr
